
Femi Falana, a Senior Advocate of Nigeria (SAN), has filed a $5 million lawsuit against Meta Platforms Inc. in a Lagos High Court, claiming invasion of privacy due to a false video about his health.
Through his lawyer, Olumide Babalola, Falana alleges that Meta published a video on their Facebook page, “AfriCare Health Center,” falsely stating he suffers from prostatitis. He argues this violates his privacy rights under Section 37 of the Nigerian Constitution and the Nigeria Data Protection Act 2023.
Falana seeks a court declaration that Meta’s continued publication of his name and images constitutes an invasion of privacy. He also requests an order for the immediate removal of the video from Facebook.
He claims the false publication has damaged his reputation and caused him emotional distress. Falana asserts that he has never suffered from prostatitis and that the video misrepresents him, portraying him in a false light.

In his affidavit, he emphasizes his reputation as a fearless advocate for civil rights and public interest litigation, highlighting his work against government overreach and for freedom of expression. He discovered the video on January 16, 2025, where he is inaccurately quoted discussing his health struggles.
Femi Falana states he has never engaged with Meta regarding his health and describes the video as misleading and unfair. He argues that the global reach of Meta’s platforms amplifies the damage, as millions have viewed the false claims.
He insists that the publication has caused him significant emotional turmoil, anxiety, and ridicule, and he holds Meta responsible for their careless publication without verification. Falana urges the court to protect his image from further harm.
